Mount Vernon Consumer Protection cites business for outdated baby medicine

MOUNT VERNON – A supermarket in Mount Vernon has been cited for have 24 different outdated items under Westchester County Consumer Code.

Officials said the most glaring violations found at Best Way Supermarket at 146 South 4th Avenue were for expired infant medications that dated as far back as 2006.

“This type of negligence is not going to be tolerated in Mount Vernon,” said Mayor Clinton Young.  “It is the job of the store owner or manager to make sure they are not selling items that have expired.  Merchants must be more vigilant in checking their items, if not we are going to do our part to protect the consumers of this community.”

In this violation there are 24 different items, but many of the items have multiple instances of expiration.  There were 23 counts of expired medication, including Tylenol Infant Drops, Motrin Drops, Children’s Tylenol Melt-away Tabs, Infant Pediacare, and an Infant Pain Reliever.

The outdated merchandise was not limited to medication. There were 38 violations for outdated assorted cereals, 16 bottles of Kraft BBQ Sauce that expired two months ago in July, along with violations for soups, frostings, and jars of tomato sauce.

The owner of Best Way Supermarket is scheduled to appear at the Office of Consumer Protection on September 16th to answer the charges of outdated merchandise.
