| Manor man gets stiff prison sentence for sexual assault |

MONTICELLO – A 39-year-old man, who pled guilty to raping a 12-year-old
girl on two occasions, was sentenced Wednesday to 50 years in state prison. Grimm was arrested on June 14, 2007 after an investigation by the Sullivan
County Family Violence Response Team. At that time, a plea bargain called for a recommended sentence of 18 years in state prison with five years’ post release supervision with a waiver of appeal. According to Chief Assistant District Attorney James Farrell, after the plea Grimm attempted to withdraw his plea and in a pre-sentence report denied responsibility for the criminal acts he admitted under oath to Judge LaBuda. That put his plea bargain and the recommended sentence in jeopardy. Farrell urged the Court to reject the negotiated sentence because Grimm failed to show remorse and accept responsibility for the sexual acts committed on the young child as was specifically required under the plea agreement. Farrell recommended that the Court impose a sentence of 25 years in state prison on each count with the sentences to run consecutively for a total of 50 years. In a ruling issued Wednesday, LaBuda agreed with the District Attorney
and threw out the previously negotiated sentence and sentenced the defendant
to 50 years in state prison for violating a specific condition of the
plea agreement. Grimm will be required to serve six-sevenths, or 85.7
percent of the sentence before being eligible for release. |
