Guilty plea in vehicular manslaughter case

KINGSTON – A Walden man, who drove his car into the path of an oncoming motorcycle killing the driver, Thursday pled guilty in Ulster County Court to vehicular manslaughter in the second degree.

Kevin Davenport, 37, was driving home from work around 6 p.m. on June 18, 2007 when he crossed lanes on Route 44/55 in the Town of Marlboro and struck a motorcycle traveling in the opposite direction. The operator of the bike was killed.

District Attorney Holley Carnright said this case is one of the first death cases in Ulster impacted by a new state law that gives a DA the ability to prosecute where a motorist’s impairment is caused by the combined influence of drugs consumed by the driver.

Lab analysis of Davenport’s blood revealed he had Diazepam, Methadone, Oxycodone and Trazodone, as well as Cannabis, in his blood stream at the time of the crash.
