Yonkers cop indicted for use of excessive force against civilian, by federal grand jury

WHITE PLAINS – A federal grand jury has indicted a Yonkers City police officer for violating the civil rights of a woman by using excessive for against her, causing injuries.

Officer Wayne Simoes, 38, of Yonkers, was arrested June 27 in connection with the alleged incident against Irma Marquez.

On March 3, 2007, Simoes and several other police officers responded to a radio call to a restaurant in Yonkers and while there, Simoes walked over the Marquez, grabbed her around the waist from behind, lifted her into the air, and threw her, face down, to the floor, before handcuffing her.

She was hospitalized with a broken jaw and lacerations and contusions to her face and body as a result of Simoes’ use of force, the indictment charges.

His conduct was captured on videotape and witnessed by other officers.

The indicted charges Simoes with violating federal civil rights laws, which make it a crime to willfully deprive a person of rights secured and protected by the Constitution.

If convicted, Simoes faces up to 10 years in prison and a fine of $250,000.
