Evidence suppressed in fatal stabbing trial of Newburgh teen

GOSHEN – Key evidence in the trial of a 13-yer-old boy who is charged with manslaughter in connection with the stabbing death of a 17-year-old boy during a January 13 brawl on a Newburgh street, has been suppressed.

The trial, in Orange County Family Court, Thursday saw Judge Andrew Bivona toss as evidence the use of the knife used in the killing as well as DNA evidence obtained from the knife.

Newburgh City Police had initially charged the boy with murder; however, an Orange County grand jury reduced that to manslaughter and ordered the case to be heard in Family Court.

The accused boy’s mother is with him during the trial.
