| Off-duty cop indicted for killing man while playing with gun |

WHITE PLAINS – An off-duty Eastchester police officer has been indicted by a Westchester County grand jury on a charge of second-degree manslaughter in connection with the shooting death of Andre Everett on November 3, 2009. James Pileggi, 29, of Eastchester faces five to 15 years in state prison if convicted. Everett, a New Rochelle realtor, was inside his home on Albert Place in New Rochelle that evening when he went to his driveway to talk to a group of acquaintances who were sitting in Pileggi’s car. He was sitting in the front passenger seat playing with his off-duty gun, a Glock .9 mm with a laser light affixed. At some point while Everett was standing by the rear driver’s door, Pileggi fired the weapon and the bullet struck Everett in the throat. He was pronounced dead at a local hospital.
