| Same sex marriage case to be argued in Court of Appeals |

ALBANY – The New York Court of appeals Tuesday will hear oral arguments in Albany Tuesday on a case recognizing out-of-state marriages of same-sex couples in Westchester County. In June 2006, County Executive Andrew Spano issued an executive order stating that Westchester could officially recognize out-of-state marriages of same-sex couples the same way as it currently recognizes marriages of different-sex couples. Three months later, the Alliance Defense Fund, representing purported New York taxpayers, sued the county executive claiming that he did not have the right to issue the order. Lamba Legal intervened in the case. The Westchester County State Supreme Court reaffirmed the law concerning out-of-state marriages, including those of same-sex couples. The case was then appealed to the Appellate division of State Supreme Court, which affirmed the case.
